‘Real reason Supreme Court could not sack Tinubu as president’

Senior Advocate of Nigeria, Robert Clarke has revealed that an amendment of the 1999 constitution will put an end to Electoral litigations.

Senior Advocate of Nigeria, Robert Clarke has revealed why the Supreme Court could not overturn the results of the February 25 presidential election which saw Bola Tinubu emerge winner.

Dockaysworld earlier reported that the apex court on Thursday upheld the victory of the former Lagos State governor while throwing out Atiku and Obi’s petition.

The court cited failure to prove their allegations of electoral irregularities and non-compliance with the Electoral Act.

Reacting to the verdict, Robert Clarke said until the 1999 constitution is amended, there will be no end to electoral disputes.

The senior lawyer who spoke on Channels Television reiterated that the highest court in Nigeria cannot cancel  presidential election results due to the constitutional provision that considers whatever the Independent National Electoral Commission (INEC) presents as correct.

He added that the constitution has given INEC too much power which he considered problematic.

Clarke stated that in the history of presidential tussles in Nigeria, the Supreme Court has never sacked any president and they might not do so in twenty years to come until the constitution where INEC enjoys an advantage, and the courts are bound to accept its presented documents as correct, is amended.
