Man sues bank for leaking financial information that he’s broke


The owner of New mega Africa Ltd Kirui Kamwibua, has sued Absa bank, Kenya, for allegedly leaking the state of his account to their parties.

The businessman alleged that the leaking of the information had jeopardized his business as creditors no longer had faith in it.

He is seeking damages of Ksh192 million as loss of income, Ksh1.2 billion for loss of goodwill, and Ksh92 million for the loss of fixed assets in the lawsuit filed before Mombasa Commercial Bank Admiralty court.

He accused an employee of the establishment as being responsible for the sharing of his information.

Kamwibua said;

“As a result of the leakage, the plaintiff’s creditors and other suppliers descended upon him and interrupted the business operations.”

The bone of contention by Kamwibua is that the exposure of his financial statement was a breach of privacy. He had requested the bank restructure its loan obligations but has alleged that he was ignored, resulting in financial sabotage.
