The Supreme Court has declared that Senator Samuel Anyanwu remains the rightful National Secretary of the Peoples Democratic Party (PDP), overturning his earlier removal by lower courts.
The apex court delivered its judgment on Friday, ruling unanimously that both the Federal High Court and the Court of Appeal in Enugu acted beyond their powers by interfering in the party’s internal matters.
In a decision led by Justice Jamilu Tukur, the Supreme Court stated that the lower courts had no jurisdiction to handle issues concerning the internal affairs of a political party.
As a result, the apex court upheld a minority judgment from the appellate court, which had dismissed the original case against Anyanwu due to jurisdictional limits.
The Supreme Court further ruled that Aniagu Emmanuel, who had initiated the legal action that led to Anyanwu’s removal, lacked the legal right to file the case.
The court declared that Emmanuel did not demonstrate how Anyanwu’s position as National Secretary directly affected him.
Previously, the Court of Appeal had supported a High Court judgment that sacked Anyanwu and recognized Chief Udeh-Okoye Enemchukwu as the National Secretary.
The appellate court argued that Anyanwu had breached the PDP’s constitution by continuing to hold the position after contesting the Imo State governorship election.
Unhappy with the rulings from both courts, Anyanwu appealed to the Supreme Court, which ultimately restored him to his position.
I did not even read this but why is court interfering in political party issues, we all know that the ruling party is always at the helms of affairs in judiciary which means the ruling party will be the one to give judgement on the case, and no ruling party will want it’s opposition to be stronger than him in other words they will always look for a way to destabilize them and cause disunity among them, it is their party and they say they don’t want someone as principal officer why forcing it on the party
